Permenhub 108/2017 Beri Kepastian Bisnis Transportasi Berbasis Online
Berita Islam 24H - Masifnya perkembangan transportasi berbasis aplikasi (online) mewarnai dinamika perkembangan bisnis transportasi sepanjang 2017. Perkembangan moda transportasi yang melesat begitu cepat ini sempat menimbulkan pro-kotra, khususnya dalam hal pengaturan regulasinya.
Salah satunya, saat Mahmakah Agung (MA) dalam putusannnya Nomor 37 P/HUM/2017 tanggal 20 Juni 2017 mengabulkan permohonan gugatan yang disampaikan enam pemohonannya.
Dalam putusannya, MA mencabut 14 pasal dari 72 pasal yang ada dalam Permenhub No.26/ Tahun 2017 tentang transportasi berbasis aplikasi.
Pro-kontra terus bermunculan paska terbitnya keputusan MA yang membatalkan Permenhub soal keberadaan taxi online. Setelah proses yang cukup lama, terbit Permenhub Nomor 108 Tahun 2017.
Beleid yang terbit pada 1 November 2017 merupakan revisi dari Permenhub No.26/2017 yang mengatur Penyelenggaraan Angkutan Orang dengan Kendaraan Umum Tidak Dalam Trayek.
“Peraturan Menteri Perhubungan yang baru ini merupakan peraturan pengganti PM 26/2017 yang sebelumnya telah dianulir oleh Mahkamah Konstitusi,” kata Sekjen Kemenhub, Sugihardjo di Jakarta, Selasa (31/10).
Ada sembilan substansi yang menjadi perhatian khusus dalam Permenhub No. 108 Tahun 2017 yaitu, argometer, wilayah operasi, pengaturan tarif, STNK, kuota, domisili TNKB, persyaratan izin, SRUT, dan pengaturan peran aplikator.
Pemerintah pun memberi batasan untuk setiap taksi online bahwa aturan ini mulai berlaku dari Februari 2018. Peraturan dari uji KIR, penempelan stiker, SIM A Umum, hingga penetapan tarif batas atas dan tarif batas bawah dengan evaluasi yang akan dilakukan setiap 6 bulan sekali.
Peraturan yang dikeluarkan pemerintah ini bertujuan untuk melindungi konsumen atau penumpang. Lewat aturan ini maka perusahaan taksi online tidak seenaknya memasang tarif.
Selain itu, tarif batas bawah dan atas juga dinilai akan memberikan perlindungan kepada para sopir taksi online agar tetap bisa mendapatkan penghasilan yang layak. Sanksi tegas juga akan diberikan bila taksi online tidak memenuhi ketentuan tarif bawah dan atas.
Sugihardjo meminta semua pemangku kepentingan termasuk angkutan online dan konvensional mematuhi Permenhub No. 108 Tahun 2017. Sebab, proses penyusunannya sudah mengakomodasi semua pihak, dengan mempertimbangkan UU 20 Tahun 2008 ttg UMKM dan UU 22 Tahun 2009 tentang Lalu Lintas Angkutan Jalan. [berita-islam24h.com / jpc]
